Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ErgoVision mobile application, web application, and related services (collectively, the “Service”), operated by Visionify, Inc., a Delaware corporation with offices at 1499 W 120th Ave, Ste 110, Westminster, CO 80234, USA (“Visionify”, “we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms.

These Terms supplement, and where applicable are superseded by, the master Visionify Terms of Use, Customer License Agreement, and Service Level Agreement available at visionify.ai/legal.

1. Eligibility & Accounts

You must be at least 18 years old and authorized to act on behalf of any organization you represent. You are responsible for all activity under your account and for keeping your credentials secure.

2. Acceptable Use

You agree not to:

  • Use the Service to assess any person without their knowledge or consent where such consent is required by applicable law.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to violate any law, including workplace privacy, biometric data, or labor laws.
  • Resell, sublicense, or provide the Service to third parties without our written permission.

3. Subscription & Billing

Paid plans (currently “Pro”) are billed in advance on a recurring monthly basis through Stripe. You authorize us to charge your payment method on each renewal until you cancel. Cancellation takes effect at the end of the current billing period.

Prices are listed in USD and may change with at least 30 days’ notice. Refunds are governed by our Refund Policy.

4. Free Trial

Each account is entitled to a free trial limited to 10 assessments. No credit card is required for the trial. After the trial, continued assessment creation requires an active Pro subscription.

5. Ergonomic Assessment Disclaimer

ErgoVision is a decision-support tool for trained safety professionals. REBA, RULA, and other scoring outputs are informational and do not constitute medical, legal, or regulatory advice. You are responsible for validating results in your specific workplace context and for compliance with applicable occupational safety standards (e.g., OSHA, ISO 11226, ISO 11228, ANSI/HFES 100).

6. Your Content

You retain ownership of all assessment data, photos, and reports you create using the Service. You grant Visionify a limited license to store, process, and display that content solely to provide the Service to you.

7. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Visionify. No rights are granted to you except as expressly stated in these Terms.

8. Termination

You may cancel your subscription at any time from your account settings. We may suspend or terminate accounts that violate these Terms or fail payment.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

To the maximum extent permitted by law, Visionify’s total liability arising out of or relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws principles. Any disputes shall be resolved in the state or federal courts located in Adams County, Colorado.

12. Changes

We may update these Terms from time to time. Material changes will be notified by email or in-app banner at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance.
